Agreement
These Terms of Service govern access to and use of Buzzlist, a software product owned and operated by Visitor InSites Inc.
By creating an account, purchasing a subscription, or using Buzzlist, you agree to these Terms. If you use Buzzlist for a company or another organization, you represent that you have authority to accept these Terms for that organization.
The service
Buzzlist provides business contact discovery, company research, prospect-list management, sales briefs, AI-assisted outreach, exports, and related sales and marketing tools.
Features, limits, data coverage, and availability vary by subscription. Certain announced or preview features may not yet be generally available.
Accounts and workspaces
You must provide accurate account information and keep it current.
You are responsible for:
- Protecting your login credentials
- Activity performed through your account
- Managing workspace users and permissions
- Promptly removing users who should no longer have access
- Notifying us of suspected unauthorized access
Accounts and credits may not be transferred, shared outside the authorized organization, resold, or combined to evade usage limits.
Subscriptions and automatic renewal
Paid Buzzlist plans renew automatically each month using the payment method on file unless cancellation becomes effective under the cancellation policy below.
By purchasing a subscription, you authorize Visitor InSites Inc. and its payment processor to charge:
- Recurring subscription fees
- Approved recurring add-ons
- Approved contact or AI credit purchases
- Applicable taxes
- Other purchases you authorize through your account
Pricing and plan features are shown at checkout or in your Buzzlist account.
Cancellation
Buzzlist subscriptions are month-to-month and do not require a fixed-term contract.
You may cancel at any time through your Buzzlist billing settings, before your next renewal date.
Cancellation takes effect at the end of your current paid billing period, and you will not be charged again. You may reverse a cancellation before that period ends.
There are no prorated cancellations, prorated refunds, or partial-month credits. Customers retain access to paid features through the end of the current paid service period, subject to these Terms.
Enterprise subscriptions may be governed by an Order Form or separately signed agreement. Unless that agreement states otherwise, notice of nonrenewal must be provided at least 30 days before the renewal date.
Removing a payment method, disputing a valid charge, stopping use of the service, or failing to log in does not constitute cancellation.
Fees and taxes
Fees are stated in United States dollars unless otherwise noted.
Customers are responsible for applicable taxes, duties, and government assessments, excluding taxes based on Visitor InSites Inc.'s income.
We may change future pricing by providing reasonable advance notice. A price change will not alter amounts already paid for the current billing period.
Credits and usage allowances
Contact credits, AI credits, searches, records, exports, and other allowances are governed by the customer's current plan.
Unless a specific offer states otherwise:
- Included monthly credits reset at the start of the next billing cycle
- Unused included credits do not roll over
- Credits have no cash value
- Credits cannot be transferred between unrelated accounts
- Credits may be revoked when obtained through fraud, abuse, duplicate accounts, chargebacks, or policy violations
Buzzlist will not knowingly charge a reveal credit when no eligible contact information is returned. Previously revealed records should remain available within the authorized workspace, subject to retention and account-status rules.
Free accounts and trials
Free access is intended to let a legitimate person or business evaluate and use the available free features.
A person or organization may not create or coordinate multiple accounts to obtain duplicate free benefits, evade restrictions, or exceed usage limits.
We may place an account under review, require additional verification, limit features, withhold credits, or close accounts when we reasonably detect abuse.
Data ownership and license
As between the customer and Visitor InSites Inc., Visitor InSites Inc. and its licensors retain all rights, title, and interest in Buzzlist, its database, its data compilation, and the professional and business information made available through the service.
Accessing, revealing, saving, or exporting a record does not transfer ownership of that information to the customer.
Subject to these Terms, Buzzlist grants the customer a limited, non-exclusive, non-sublicensable license to use professional and business information lawfully obtained through Buzzlist for the customer's internal sales, marketing, research, and business-development activities.
Information lawfully revealed and incorporated into the customer's own CRM, records, reports, or workflows during an active subscription may continue to be used for those permitted internal business purposes, subject to applicable law, privacy rights, suppression requirements, and these Terms.
Customers may not resell, sublicense, publish, redistribute, or use Buzzlist information to create, enrich, or operate a competing data product or service.
Customers may export data only within the limits of their subscription, and may not:
- Use automated means to scrape, extract, or bypass product controls
- Circumvent reveal, credit, export, field, or plan restrictions
- Attempt to identify Buzzlist's data suppliers or expose proprietary source identifiers
- Use data for consumer reporting or eligibility decisions
- Use data for employment screening, credit, insurance, housing, or tenant decisions
- Use data for unlawful, deceptive, discriminatory, or abusive conduct
- Contact people in violation of applicable laws or valid opt-out requests
Customer content
Customers retain ownership of information and original content they submit to Buzzlist, including their business information, notes, instructions, uploaded files, and customer-created materials.
Customers grant Visitor InSites Inc. permission to host, process, and transmit that content only as reasonably necessary to provide, secure, support, and improve the Buzzlist service, subject to the Privacy Policy.
You represent that you have the rights and lawful basis needed to submit and use that content.
AI-generated content
AI-assisted research, briefs, and messages may be incomplete or inaccurate.
You are responsible for:
- Reviewing outputs before use
- Confirming material factual claims
- Confirming contact suitability
- Following applicable outreach and marketing laws
- Deciding whether and how to send generated content
Buzzlist is not responsible for replies, meetings, conversions, revenue, or other business outcomes.
Acceptable use
You may not:
- Break or attempt to bypass authentication, authorization, billing, or credit controls
- Access another customer's workspace
- Reverse engineer or interfere with the service
- Introduce malicious code
- Conduct excessive automated requests
- Use Buzzlist to facilitate spam, fraud, harassment, or unlawful surveillance
- Misrepresent your identity or affiliation
- Infringe intellectual-property, privacy, or publicity rights
- Use the service in violation of law
We may suspend access while investigating suspected abuse, fraud, security incidents, payment failures, or legal violations.
Third-party services
Buzzlist may connect with third-party services such as payment processors, authentication providers, AI providers, email platforms, and data providers.
Third-party services are governed by their own terms. Visitor InSites Inc. is not responsible for third-party systems outside its reasonable control.
Availability and changes
We work to keep Buzzlist available and reliable, but uninterrupted operation is not promised.
We may modify, replace, limit, or discontinue features when reasonably necessary for security, compliance, performance, cost, or product development.
We will use reasonable efforts to avoid materially reducing a paid service during an active paid period without notice.
Intellectual property
Buzzlist, its software, design, branding, databases, workflows, documentation, and related intellectual property belong to Visitor InSites Inc. or its licensors.
No ownership rights are transferred to customers.
Suspension and termination
We may suspend or terminate access for:
- Nonpayment
- Chargebacks or suspected payment fraud
- Security risk
- Abuse of free accounts or credits
- Violation of these Terms
- Unlawful use
- Risk to Buzzlist, its customers, providers, or systems
Customers remain responsible for charges incurred before termination becomes effective.
Disclaimers
Buzzlist is provided on an "as available" basis.
To the fullest extent permitted by law, Visitor InSites Inc. disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not warrant the completeness or accuracy of third-party, public, licensed, inferred, or AI-generated information.
Limitation of liability
To the fullest extent permitted by law, Visitor InSites Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, opportunities, or data.
Visitor InSites Inc.'s aggregate liability arising from Buzzlist will not exceed the amount the customer paid for Buzzlist during the three months immediately preceding the event giving rise to the claim.
Some jurisdictions do not permit certain limitations, so portions of this section may not apply.
Indemnification
You agree to defend, indemnify, and hold harmless Visitor InSites Inc., its officers, employees, and affiliates from claims, losses, and expenses arising from:
- Your misuse of Buzzlist or its data
- Your violation of these Terms
- Your outreach or marketing activity
- Your violation of law or third-party rights
- Content you submit or distribute
Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any permitted legal action relating to these Terms must be brought in a state or federal court located in Florida, and the parties consent to that jurisdiction.
Changes to these Terms
We may update these Terms as Buzzlist changes. Material changes will be posted with a revised effective date, and additional notice may be provided through the service or by email.
Continued use after an updated version becomes effective constitutes acceptance of the updated Terms.
